Can u pls guide me in starting an online liquor sales startup that I’m currently working on? I want to know if there is any license requirement for online selling of wine/liquor in India.

There will be restriction from Payment gateways for selling Liquor online.That is the reason liquor is seldom sold online. Though rules and restriction vary for each PGs. Additional hurdles will be ensuring you dont end up encouraging under-age drinking  Though no separate license is required for online selling.

    • Hey Anand,

      No special license is required to sell online. But if you do wanna start an online store, here are some things to keep in mind:

      1. For starting any business , you need a valid license like License under Shop and Establishment Act (Basic) or Incorporation Certificate for Companies, etc

      2. TAN no. is not mandatory for Sole Proprietors unless your turnover in the previous financial year exceeded 1 crore.

      3. Service Tax Registration is applicable only for Service Providers only. If during a financial year your company crossed 9 lakhs in turnover for service provided, then registration is mandatory within 30 days.
      And Service Tax is to be paid on the amount exceeding 10 lakhs. This exemption limit of Rs 10 Lakhs applies only for the first year and from second year onwards service tax has to be paid on all amount received towards taxable services

      4. VAT is mandatory when the gross turnover exceeds 5 lakhs. However for imports registration is mandatory when it exceeds 1 lakhs. VAT has to be charges on the imported products as well as per the VAT schedule.

      5. Other licenses required for Proprietorship are Profession Tax or any business specific licenses (Say if Food industry then, License under FSSA). As such for general business only these are the required.​

      6. IEC is mandatory if you are shipping internationally. And for which, the pre-requisite is a registered firm.

    Even if it’s miniatures, no courier company will take responsibility for shipping it. It’s against logistics’s companies guidelines and hence they won’t take it up. Couriering of this would have to be handled by yourself.

    You can definitely start an online store for your wine shops in Navi Mumbai. Although there are a couple of things that you should keep in mind, before starting one:

    1. You won’t be able to get a payment gateway for your store. No PG company approves it for a liquor store. So you will either have to go ahead with COD or Bank Transfers.

    2. Logistics will be need to be taken care of by yourself. No logistics company will help with delivery of fragile items or alcohol.

    3. You wont be able to run Google AdWords for your store. Google doesn’t approve ads for alcohol or drugs. So you will need to look at other ways of marketing your store, apart from running ads.

    I have seen websites like Winebazaar.in and livingliquidz.com coming with ecommerce shopping. is it possible that i too start the same ? How did they start off ? What kind of legal problems could arrive in Liqour shopping ?
    Are u also saying that No liqour licence is required ??
    What sort of restrictions would be possible from PGs ?

    • Hi Sunil,

      You can definitely start selling liquor online but there are a couple of things to keep in mind, before you start the same:

      1. To avoid running into legal hassles, your bar license should be notarized and stamped. And you’ll need to put up the same on your website so that it’s visible at all times.

      2. No payment gateway agrees to providing a payment gateway for sale of liquor online. So you will need to go ahead with COD option.

      3. Again, no logistics service in India, will extend courier support for liquor. So you will need to have your own logistics in place.

      4. Please keep in mind the minimum drinking age for the city or state you’d like to operate in. You will need to ask for ID proof before you hand over liquor sold online so as to avoid running into legal problems. Because selling liquor to underage patrons is a crime in India.

      5. And finally, all these terms and conditions should be highlighted on your website.
